General Terms and Conditions

 I. Scope of application

  1. These general terms and conditions of sale apply to the rental of guest rooms for accommodation purposes and to all other services provided to the customer(s) by SARL Château le Val (hereinafter referred to as: Château Le Val).
  2. The subletting or subsequent rental of the rooms made available, or their use for purposes other than accommodation, requires the prior written consent of Château le Val.
  3. The customer's terms and conditions of sale are only applicable if agreed in writing in advance. 


II. conclusion of contract, -partners, prescription

  1. The contract is concluded by the acceptance of the customer's request by Château le Val. Acceptance takes the form of a booking confirmation from Château le Val. The customer is free to confirm the room reservation in writing.
  2. The contracting parties are Château le Val and the customer. If a third party has ordered for the customer, he/she is jointly and severally liable to Château le Val for all obligations arising from the accommodation contract. Irrespective of this, the third party is obliged to provide the customer with all information relating to the booking, in particular the general terms and conditions.
  3. All claims against Château le Val are subject to a limitation period of one year from the start of the statutory limitation period. Claims for damages are subject to a five-year limitation period. The reduced limitation period does not apply to claims based on an intentional or grossly negligent breach of Château le Val's obligations.
  4. Reservations may only be made by persons with full legal capacity. 


III. Services, prices, payment, compensation

  1. In principle, Château le Val is obliged to make available the category of room(s) booked by the customer and to provide the agreed services. Château le Val may, if necessary from Château le Val's point of view, provide the customer with a small family room or a family room instead of a double room, or a family room instead of a small family room.
  2. The customer acquires no right to the provision of specific rooms, a reservation by room name is not possible, unless Château le Val has confirmed in writing the provision of specific rooms.
  3. Château le Val is entitled to accommodate customers at the reserved price in other accommodation with comparable facilities and services, without any recourse being possible against Château le Val, if there is an important reason, in particular if accommodation in the reserved Château le Val is not possible.
  4. The customer is obliged to pay Château le Val's current or agreed prices for the provision of the room and other services. This also applies to services and expenses provided by Château le Val to third parties on the customer's initiative. 
  5.  The agreed prices include the statutory VAT applicable at the time the contract is concluded. Local taxes provided for by municipal law (tourist contribution) are not included in the room rate and must be paid in addition.
  6. Prices may be modified by Château le Val if the customer subsequently wishes to change the number of rooms booked, the services provided by Château le Val or the duration of the guest's stay, and if Château le Val agrees.
  7. Château le Val is entitled to demand appropriate advance payment on conclusion of the contract. The amount of the advance payment and the dates of payment are normally agreed with the customer in writing.
  8. Unless otherwise agreed, Château le Val invoices must be paid by the time of departure at the latest. The customer may only set off or reduce a claim against Château le Val with an undisputed or legally enforceable claim. 


 IV. Withdrawal (cancellation) / Non-utilization of reserved services (no-show)

  1. The customer's right of withdrawal must be exercised in writing to Château le Val.
  2. The hotel grants the customer a right of cancellation in accordance with the following provisions:
  3. Free cancellation is possible up to the day prior to arrival, unless otherwise agreed. Cancellations must be made in writing.
  4. In the event of cancellation on the day of arrival, or in the event of a no-show, Château le Val will charge 100% of the contractually agreed room rate for the entire duration of the stay.
  5. In the event of cancellation on the day of arrival and for bookings of more than one night, Château Le Val will try to rent the room booked by the customer to another person. In the event of re-letting, this revenue will be deducted from the price agreed for the room of the no-show customer. 


 V. Cancellation by Château le Val

  1. If it has been agreed in writing that the customer may terminate the contract free of charge within a certain period, Château le Val is also entitled to terminate the contract during this period.
  2. Notwithstanding the above, Château le Val is entitled to terminate the contract exceptionally for objectively justified reasons, in particular in the event of :
  3. force majeure or other circumstances beyond the control of Château le Val render performance of the contract impossible
  4. failure to make advance payments as agreed in the contract.
  5. Justified cancellation by Château le Val does not entitle the customer to damages.
  6. Château le Val must immediately inform the customer of the exercise of its right of withdrawal.
  7. Château le Val may suspend or interrupt events that have not been agreed/authorized.
  8. In the event of justified withdrawal by Château le Val or interruption of an unauthorized event in accordance with point 5 above, the customer is not entitled to claim any compensation. 


 VI. Arrival and departure

  1. Booked rooms are normally available to guests from 5.00 p.m. on the agreed date of arrival, unless earlier arrival has been agreed in advance. The customer has no right to earlier availability.
  2. Reserved rooms must in principle be occupied by the customer by 7.00 pm on the agreed day of arrival, unless a later arrival has been agreed in advance in writing.
  3. On the agreed day of departure, rooms must be vacated by Château le Val by 11:00 am at the latest. After this time, Château le Val may charge 50% of the room price (list price) for late vacating of the room for use not in accordance with the contract up to 2:00 pm, and 100% thereafter. 


 VII. Liability of Château le Val

  1. Château le Val is liable for all obligations arising from the contract, excluding any claims for damages on the part of the customer. Excluded from this provision are damages resulting from injury to life, limb or health, as well as other damages, if Château le Val is responsible for the intentional or grossly negligent breach of its obligations in the performance of its contractual duties. Should any disturbances or defects occur in the services provided by Château le Val, Château le Val will endeavour to remedy them as soon as it becomes aware of them or upon complaint by the customer. The customer is obliged to do whatever is reasonably required of him to remedy the disturbance and limit any possible damage.
  2. No liability is accepted for valuables taken or left in the rooms.
  3. Insofar as a parking space is made available to the customer in the parking lot, even against payment, no contract of custody is concluded. Château le Val is not liable for the disappearance of or damage to motor vehicles, trailers, motorcycles or bicycles parked or manoeuvred on the property and their contents, except in the case of wilful misconduct or gross negligence. 
  4. Wake-up orders are executed by Château le Val with the utmost care. Claims for damages are excluded, except in cases of gross negligence or wilful misconduct.
  5. Messages, mail and goods intended for customers are handled with the utmost care. Claims for damages are excluded, except in cases of gross negligence or wilful misconduct.
  6. Smoking is strictly prohibited in all enclosed areas of the hotel. In the event of infringement, Château le Val will charge a fee of EUR 300.00. Château le Val reserves the right to claim higher damages, e.g. if Château le Val is billed for a fire department intervention for this reason, or if a fire caused by an unauthorized smoker has caused damage to the building.
  7. Lost and found will only be sent on request, at the customer's risk and expense. Château le Val will keep items for 6 months, after which they will be destroyed if they have no apparent value. 


 VIII. final provisions

  1. All modifications or additions to the contract, to the acceptance of the application or to these general terms and conditions of hospitality must be made in writing. Unilateral modifications or additions made by the customer are without effect.
  2. The place of performance and payment is the registered office of Château le Val. French law is applicable. The application of the United Nations Convention on Contracts for the International Sale of Goods and its conflict-of-laws rules is excluded.
  3. Should individual provisions of these general terms and conditions be ineffective or invalid, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
